As it stands, Maltese law does not preclude the coexistence of a Maltese Patent and an EP with Unitary Effect, and the Malta IP Office intends processing timely double patent applications which will be filed once the Unitary Patent comes into effect on 1 April 2023.
Update: the Unitary Patent system and the Unified Patent Court came into operation on 1 June 2023, later than the 1 April 2023 date expected when this note was written. Malta has been part of the system since that date.
