On 12th January 2023, the Court of Appeal, presided over by Mr. Justice Giannino Caruana Demajo, Mr. Justice Tonio Mallia and Mr. Justice Anthony Ellul, coined the appeals filed by Strabuono Coffee International Limited “frivolous and vexatious”, and ordered the defendant to pay double expenses in both appeals. In its judgements, the Court of Appeal confirmed the judgements of the First Hall of the Civil Court, which, exactly a year before, on 12th January 2022 found the defendant’s use of any and all forms of the term ‘Strabuono’ to be in violation of Starbucks Corporation’s intellectual property rights on the basis of trademark infringement as well as unfair competition.
